Partner (Provisional) visa – SC 309

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 100).

To Be Eligible:

 

    • be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident, or eligible New Zealand citizen
    • have your spouse or de facto partner sponsor you
    • be outside Australia when you apply for this visa and when we decide your temporary visa application. Family who applies with you must also be in Australia.
    • not had a visa cancelled or an application refused
    • not hold certain regional visas
    • be in Australia when you apply
    • have a sponsor
    • be the right age
    • meet relationship requirements
    • meet our health requirement
    • meet our character requirement
    • have no debt to the Australian Government
    • best interests of the child.
    • You must be in Australia when you apply and when DoHA decide on your temporary visa application. Family who applies with you must also be in Australia.

      If granted, the applicant can

       

        • sponsor eligible family members to come to Australia
        • You become a permanent resident on the day we grant the visa
        • if eligible, apply for Australian citizenship.
        • stay in Australia as a permanent resident
        • work in Australia
        • study in Australia
        • access Australia’s public healthcare scheme, Medicare
        • sponsor your family members to come to Australia
        • travel to and from Australia
        • if eligible, attend free English language classes provided by the Adult Migrant English Program
        • You and your family members must meet all visa conditions and obey Australian laws.
